Uncleared Derivative Margining Rules – Some Good News for End Users and Banks Doing Business with End Users

European regulators adopt final rules for margin requirements for non-centrally cleared derivatives.

  • While the U.S. regulators have not yet announced similar final rules, European regulators seem to have provided a blueprint to their U.S. counterparts.
  • European regulators largely exempt non-financial companies and end users from posting collateral for non-centrally cleared derivatives.
  • If similar approach is taken by U.S. regulators, it will be a positive step for the end-user community (commercial borrowers and community and regional financial institutions) in the U.S.
